“At Cardekho SEA, we value our customers and are committed to protecting your privacy and safeguarding the information we receive and maintain about you. We only share your information as expressly allowed by law. This Personal Data Protection Notice (“Notice”) will help you understand what information we collect, how we use it, and how we maintain your privacy and the security of your personal information.

ATTENTION

Please read the terms of this Notice carefully before using our Sites. By accessing our Sites, you are deemed to have agreed to all the terms in this Notice. If you do not agree, you should discontinue use of the Sites.

What This Notice Covers

This Notice describes how Cardekho SEA uses your Personal Data when you visit our Sites and use our services. This Notice does not describe information collection policies on other sites, including those linked to or from the Sites.

If you disclose personally identifiable information to a third party, this Notice will not apply and you will be subject to the personal data notice of that third party (if any).

Words defined in the Sites’ Terms of Use have the same meaning in this Notice, unless otherwise defined herein.

The Personal Data Gathered by Cardekho SEA

Cardekho SEA collects Personal Data that it considers necessary for it or its related companies/corporations to provide the range of services offered by Cardekho SEA. Providing your Personal Data is voluntary. However, if you do not provide your Personal Data, Cardekho SEA may not be able to (i) communicate with you; (ii) provide you the services you require or (iii) you may not be able to access certain sections of the Site.

Although providing your Personal Data is voluntary, it is necessary for us to process it to provide you with our services. Without it, we may not be able to continue using your Personal Data for the purposes stated in this Notice.

“Personal Data” means information about you which you have provided to Cardekho SEA, such as your name, address, telephone number, NRIC No., email address, your personal preferences, bank account information, IP addresses, photographs and images, call recordings of you and any other information which may identify you that has been or may be collected, stored, used and processed by Cardekho SEA from time to time which includes but is not limited to the information further described below.

Information supplied by visitors when they use the Sites to:

Create a new account;
Login to their account;
List, modify, remove the posting of a vehicle (for sale) ad;
Perform a search;
Click to reveal seller information;
Enter a sweepstakes or other promotional contest;
Request a response which includes but is not limited to requests for test drives and such other requests for responses from sellers; and
Enquire about a vehicle listed for sale or about another product or service offered through the Sites.
Enquire about new car offers.
Enquire about insurance plans on the website.

COLLECTION OF PERSONAL DATA

Your Contact Details:

Your full name, age, address, email id, phone number, date of birth, gender, financial information, any other sensitive personal data or information etc. We collect your Personal Information when you create an account on our platform, fill out a form, or respond to a survey.

Cardekho SEA may use your email address and/or telephone number(s) to respond to requests you make for Cardekho SEA’s products or services or to respond to your communications with Cardekho SEA. Cardekho SEA may also contact you to inquire about your experience on the Sites, to provide you with information about the products and services available from Cardekho SEA and/or its affiliates, or to communicate to you information related to the automotive industry. From time to time, Cardekho SEA may contact you via telephone and/or send you emails, MMS, SMS and/or Line messages that include special promotions and other commercial offers that Cardekho SEA thinks may be of interest to you. We hope you will find these communications informative and useful. If you do not, you can unsubscribe at any time from any of our commercial marketing/ communication programs by following the simple instructions included in an email you receive in connection with the respective programs.

If you request for a car using our Latest Car Requests, Cardekho SEA will use and share your email address and other relevant Personal Data with participating dealers.

Searches and Listings:

To make use of certain features on the respective Sites, visitors need to provide limited information about themselves and their interests so that Cardekho SEA can tailor the information Cardekho SEA provides to their needs.

For example, to help you find the car you want close to home, Cardekho SEA will need to know what kind of car you are looking for and your location. Cardekho SEA might ask you to provide this information when you perform a search and this information is utilized by Cardekho SEA to help you find the car you are looking for or as otherwise described in this Notice.

Sweepstakes and Other Promotions

From time to time, Cardekho SEA may offer sweepstakes or other promotions on the respective Sites. If you enter a sweepstakes or promotional contest, you will be required to provide information about yourself (such as your name, NRIC No./ passport no., telephone number, address, date of birth, and email address). Among other things, Cardekho SEA will use this information to contact you if you win, and Cardekho SEA may also use this information for marketing purposes and such information may therefore be published or made public. Cardekho SEA may share this information with any co-sponsor/ co-organiser of the contest or sweepstakes; Cardekho SEA will identify the co-sponsor/ co-organiser in the contest rules. Cardekho SEA may also share this information with shipping or fulfillment companies or other third-party service providers that help administer our promotions, such as by conducting drawings, and/or delivering prizes to winners. If you do not want Cardekho SEA or such other third parties to collect the information requested in the contest or sweepstakes registration form or to provide it to co-sponsors/ co-organisers, please do not enter the contest or sweepstakes.

Online Surveys

From time to time, Cardekho SEA may conduct a survey on its users to measure their satisfaction with the Network and to help Cardekho SEA learn more about its audience and how they interact with the Cardekho SEA Network. Third-party research firms often conduct these surveys on our behalf. Cardekho SEA uses the survey results to help it improve the services that it offers to you. Cardekho SEA will take the information you provide and aggregate it on an anonymous basis with data collected from other survey participants. Cardekho SEA may use and disclose that pool of anonymous information as it sees fit, without identifying you personally.

You may also find on the Sites, invitations to participate in surveys conducted by advertisers of Cardekho SEA, whose personal data protection policies are not controlled by Cardekho SEA. These invitations will usually link to an online survey form that is hosted either by the advertiser conducting the survey or by a third-party research firm working on the advertiser's behalf. When you access an advertiser's survey through the Sites, the use and disclosure of any information you submit will be governed by the advertiser's personal data protection policy (or by the personal data protection policy of the advertiser's research firm), which may differ from Cardekho SEA’s. If you cannot find the applicable personal data protection policy via a link either from the advertiser's survey invitation or from the online survey form, you should contact the advertiser directly for more information.

Your Account

To access your account, Cardekho SEA will ask you to register with Cardekho SEA on the form provided, which may include personally identifiable information such as your email address. You may also be asked to provide additional optional personal information, such as your name, gender, race and age. You agree to provide true, accurate, current, and complete information about yourself. We use this information to process your registration request, provide you with the services and communications that you request, customize features that appear on the Sites, measure traffic on the Sites, and improve the Sites and the services and features offered to users. We may share information we collect while you are using the Sites, including registration information, with our affiliates and with trusted third-party service providers who assist Cardekho SEA in providing services.

Social Networks

When you use one of the social network sharing tools available on the Sites, Cardekho SEA and the social network operating the tool may collect information about you based on such use. The social network's use of that information will be subject to its own privacy policy/personal data protection policy, which may be different from this Notice.

Content You Post to the Sites

If you choose to post information/ content to any of the interactive areas of the Sites, such as discussion forums, comments fields, Questions, Answers, User Reviews and social media areas, please keep in mind that the information/ content you post can be seen, collected, and used by anyone who has access to those areas. You may also have the opportunity from time to time to respond to questions that Cardekho SEA displays to users of the Sites. If you choose to respond, your response may be published on an area of the respective Site accessible to other users or the public. We are not responsible for any third-party use of such information/ content.

Purposes of Processing Personal Data

Cardekho SEA may further use, process, transfer, and/or disclose your Personal Data for the following purposes without limitation:

A. send newsletters, articles, write-ups as well as other updates and information to you as requested and to notify you from time to time about services offered by the Site or other entities associated with the Site,

B. profile and/or analyze you using and accessing the Sites and your pattern and manner of usage,

C. customize the advertising and content you see, to fulfill your requests for certain products and services, and to contact you about specials and new products, whether directly or through partners or affiliates of Cardekho SEA but for the sole purpose of fulfilling the functions above;

D. For the purposes of collaboration, cooperation, ecosystem development among affiliates of Cardekho SEA, including but not limited to the exchange of personal information and data of Users between the Cardekho SEA platform and affiliates of Cardekho SEA, both for commercial or non-commercial purposes;

E. For the purposes of collaboration with other third parties who are bound by a collaboration / partnership agreement with Cardekho SEA;

F. research, develop, and improve Cardekho SEAs services,

G. generate statistics in relation to Cardekho SEA and Cardekho SEA Network including but not limited to the conduct of market surveys and analysis relating to our products and services and customer satisfaction surveys;

H. promote and market special offers and other services to you;

I. for verification, administrative and record keeping purposes;

J. to conduct background checks and credit assessments as and when we deem necessary;

K. to process payment transactions;

L. for you to be informed by us and/or by companies within the Cardekho SEA group, whether by email, post, telephone or other telecommunication means and social media, on present or future products, services, promotions, product launches, sales carnivals etc;

M. to provide information to regulatory and governmental authorities to comply with statutory and governmental requirements;

N. for Cardekho SEA to comply with its obligations under law;

O. in connection with any legal proceedings or prospective legal proceedings;

P. to establish, exercise or defend Cardekho SEA’s legal rights; and

Q. to the purchaser (or prospective purchaser) of any business or asset which Cardekho SEA is (or is contemplating) selling.

If you do not consent to Cardekho SEA processing your Personal Data for the purposes listed above, please notify Cardekho SEA using the contact details stated below.

By providing your Personal Data to us and/or in a continuous manner, access and use our Sites, you declare that you have read and understood this Notice and accept and agree to the practices described in this Notice. You agree that your Personal Data collected by Cardekho SEA and/or posted by you on our Sites or otherwise processed through the requested service from time to time may be used for the purposes described in this Notice and Terms of Use.

Cookies And Other Data Collection Technologies

A cookie is used to monitor the use of the Sites and to gather information such as the sections of the website visited and other website usage information. The information is aggregated prior to such use and does not include any Personal Data. Our Sites use cookies to serve you more efficiently when you revisit them.

Most browsers are initially configured to accept cookies. However, you can set your browser to refuse all cookies or notify you when you receive a cookie and you will have the opportunity to either accept or reject it in each instance. Please note, however, that some parts of the services offered by the Sites may not function properly if you refuse cookies.

Web Beacons/Pixel

To help Cardekho SEA (and in some cases the advertisers and third-party providers of Cardekho SEA) keep track of how many users are accessing particular pages or listings within the Sites, and to track how users respond to ads placed by Cardekho SEA on third-party websites, Cardekho SEA may place a small file, called a web beacon, on some of the pages and on some of the listings and ads Cardekho SEA distributes.

Cardekho SEA may also place a web beacon in the emails it sends to you. When you open one of Cardekho SEA’s emails or click on links within these emails, Cardekho SEA tracks this click-through data to help it determine your interest in particular topics and measure the effectiveness of its communications to you. If you prefer not to be tracked in this way, you should not open these emails or click text or graphic links in the emails.

Information about your computer or device

Cardekho SEA’s web server (and/or any web server operated by Cardekho SEAs service provider(s) on its behalf) automatically collects and may store limited information about your computer configuration when you visit the Sites, including:

A. The type of browser software you use;

B. The operating system you are running;

C. The resolution of your computer monitor; and

D. Your IP address. (This is a numerical address that is used by computers connected to the Internet to identify your computer so that data (such as the web pages you want to view) can be transmitted to you. Cardekho SEA also uses IP address information for systems administration (including fraud detection and prevention) and troubleshooting purposes.

Cardekho SEA may also collect information about the website you were visiting before you came to the Sites and the website you visit after you leave the Sites.

Combined Technology Information

Cookies, beacons, information collected about your computer or device, and other data collection technologies ("Data Technologies") may be used individually or in combination in order to provide and/or administer Cardekho SEA’s services, to help it understand user behavior, to monitor the Sites’ performance, optimize ads and measure advertising performance.

Website Analytics

Cardekho SEA may collect, or have a third party collect on its behalf, data on how visitors use and navigate through the Sites, such as the number of users who visit various pages within the Sites, what they click on, whether they scroll up or down on particular pages, fill out forms, etc. Cardekho SEA uses this information to improve the Sites and learn about users, and may disclose it to its affiliates (including, among others, the members of the Cardekho SEA Network corporate family), or to third parties.

Advertising

The Sites have relationships with certain third-party advertising networks, Advertisers, and advertising services ("Advertising Services") that collect data, target and serve some of the advertisements, promotions, or other marketing messages you see on the Sites and other websites and mobile applications, including websites owned and/or operated by affiliates of Cardekho SEA.

Such Advertising Services may, including through processes that Cardekho SEA does not control, use Data Technologies from third party companies to collect data from your activities on these websites, on other websites owned and/or operated by affiliates of Cardekho SEA, or with other websites. These technologies may be used to track user behavior, how Cardekho SEA’s products and services are offered, conduct consumer research and possibly to serve you relevant ads and content. These companies may also obtain information, including personally identifiable information, from services you use from other companies, including without limitation, other websites, mobile websites or applications, and combine the information they obtain through these Data Technologies with information obtained through products and services provided by Cardekho SEA. Their collection and use of this data is subject to their respective privacy policies/personal data protection policies.

What If You Do Not Provide Personal Information

If you choose not to provide personal information when requested, Cardekho SEA may not be able to provide you with the full range of services as offered on the Sites. You are given the opportunity to 'opt-out' of having your Personal Information used for purposes not directly related to the Sites at the point where Cardekho SEA requests for it.

If you do not wish to have information on you used in any of the aforesaid manner, please notify Cardekho SEA using the contact details stated below. If you do not want to receive e-mail or other mail from Cardekho SEA, you can click on the unsubscribe link in the emails to remove your email address from the Cardekho SEA mailing list.

Opting Out

If you do not agree for Cardekho SEA to process your Personal Data for the purposes listed above you may object and/or withdraw your consent for us to collect, use or disclose your personal data by giving us reasonable notice. Rejection or withdrawal of consent can be done at any time by sending an email via Contact Information below (as long as there are no legal or operational restrictions preventing you from doing it). Please understand that if you withdraw your consent, we will not collect, use or disclose your personal data which may mean that you will no longer be able to use our services. We will process the request within a reasonable time after receiving your notice of consent withdrawal. Once processing is complete, we will no longer collect, use and/or disclose your personal data, except limited to storage of your personal data required for compliance purposes, statutory regulations or other laws.

How is personal information disclosed

Cardekho SEA may engage other companies, service providers or individuals to perform functions on Cardekho SEA’s behalf, and consequently may provide access or disclose to your Personal Data to the third parties such as those listed below (not exhaustive):

employees of Cardekho SEA;
the public if you advertise with the Sites or use publicly available communications services;
Cardekho SEA’s Affiliate companies which has a collaboration with Cardekho SEA in developing an ecosystem between the Cardekho SEA platform and affiliates of Cardekho SEA, for both commercial and non-commercial purposes, subject to the provisions set out in this Privacy Policy.

outsourced service providers who assist Cardekho SEA to provide its services;

marketing and market research advisers;

resellers of Cardekho SEA’s services;
organizations involved in a sale/transfer of Cardekho SEA’s assets, business, or shares;
government and regulatory authorities as required by law;
data entry service providers;
storage facility providers;
banks and financial institutions;
any professional advisors and external auditors;
regulatory and governmental authorities in order to comply with statutory and government requirements.

Except as provided herein and/or otherwise as required by law, your Personal Data will not be made available to third parties without your consent. Notwithstanding the Personal Data provided to us will generally be kept confidential, you hereby consent and authorize us to disclose your Personal Data to the following parties in Malaysia and/or overseas:

any company under the Cardekho SEA Group including those established in the future;
our business partners and affiliates that provide related products or services in connection with our business;
our lawyers, consultants, debt collection agencies, credit-reporting agencies, accountants, auditors or other financial or professional advisers and service providers;
our third party product or service providers or subcontractors as we may deem necessary;
statutory authorities, industry regulators and government agencies; and
any party to whom we are required to do so under law or in response to any competent or government agency.

Kindly be informed that if required for any of the foregoing Purposes, your Personal Data may be transferred and/or disclosed to any party within or outside Thailand including but not limited to companies within the Cardekho SEA Group including the respective licensees, agents, business partners and/or service providers and under confidentiality and security conditions.

Hyperlinks

This Notice only applies to the collection and use of Personal Data by Cardekho SEA. It does not cover third party sites to which Cardekho SEA provides links, even if such sites are co-branded with the Cardekho SEA logo. When you are on the Site, you could be directed to other sites that are beyond the control of Cardekho SEA including hyperlinks to advertisers, merchants, sponsors, and content partners. Cardekho SEA does not share your Personal Data with third party websites. Cardekho SEA is not responsible for the privacy and conduct practices of these third party websites, so you should read their own privacy policies before disclosure of any Personal Data to these websites.

You acknowledge that when you click on a hyperlink that leaves the Sites, the website which you are directed to is not within the control of Cardekho SEA, and you acknowledge that the Sites shall not be responsible for those websites or any damages or losses incurred by you resulting thereto.

Cardekho SEA will not sell your personal information to any third party without your permission, but it cannot be responsible or held liable for the actions of third party websites which you may have linked or been directed to from the Sites.

International Transfers

Please be aware that:

Cardekho SEA’s databases are stored on servers and storage devices located in Indonesia and various other parts of the world.
Your information (including Personal Data) may be transferred to, stored, used and processed in these locations for processing and storage.
These locations may not guarantee the same level of protection for Personal Data as the locality or country where you reside. By using the Sites, you expressly agree to the processing, collection, use, disclosure, and transfer of your information (including Personal Data) by Cardekho SEA for the purposes identified herein, and you consent to the transfer of such information outside of your country.
By your use of the Cardekho SEA Network, you understand and consent to the transfer of your Personal Data out of Malaysia as described herein.

About Security and Personal Information

Cardekho SEA uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your Personal Data and will not knowingly allow access to this data to anyone outside Cardekho SEA, other than to you or as described in this Notice. However, Cardekho SEA cannot ensure or warrant the security of any information you transmit to us, and you do so entirely at your own risk. In particular, Cardekho SEA does not warrant that such information may not be accessed, altered, collected, copied, destroyed, disposed of, disclosed or modified by breach of any of Cardekho SEA’s physical, technical, or managerial safeguards.

The Sites do not target and are not intended to attract children under the age of 18 years old. We do not knowingly solicit personal information from children under the age of 18 years old or send them requests for personal data.

This Notice is governed by and shall be construed in accordance with the laws of Malaysia. You hereby submit to the non-exclusive jurisdiction of the Malaysian courts.

Data Deletion Request
