Irish Volkswagen Owners All Set to Sue the Company in Millions Over Dieselgate Scandal
Kuala Lumpur: An Irish law firm - Peter McDonnell & Associates, representing 18 Volkswagen owners, is all set to sue Volkswagen in the High Court, next month, for millions of euro in damages over the infamous dieselgate scandal, claims an Irish Independent report. The scandal affected around 11 million vehicles worldwide from various brands owned by Volkswagen Group, including Volkswagen, Audi and Porsche. All these dieselgate affected vehicles were powered by Volkswagen's 1.2L, 1.6L and 2.0L “EA288” engines and the latest 3.0L TDI V6 engine having cheat devices, which adjusted CO2 emissions within the legal limit during tests but once the tests are over, the devices would again start emitting more levels of CO2 than they are certified to.
The Irish Independent considers Peter McDonnell & Associates's move as the “first major major case of its kind in the country” while claiming that is has had sight of some of the documents. The Dublin-based law firm wants Volkswagen to take back the dieselgate affected vehicles, fully reimburse their owners, and also pay them exemplary damages for the misleading them on the CO2 emissions. The solicitors will file the case on the basis of the fact that the VW dieselgate affected vehicles failed to do what the automaker claimed on emissions and since Volkswagen has no contract with the customers, the company should take back all its dieselgate-affected vehicles and refund the money to their owners. The law firm also wants a declaration from the High Court that Volkswagen AG acted in a fraudulent manner. In addition, it is also seeking "aggravated and exemplary" damages to punish Volkswagen for the cheating the owners. The law firm is also preparing at least 40 other cases against the German automaker.
Mr. Peter McDonnell told the Irish Independent that 'letters' for action have been to sent to both German and Irish headquarters of the Volkswagen and its solicitors have acknowledged them. The proceedings will be issued in 2016. Volkswagen has hired Dr. Christine Hohmann-Dennhardt from Daimler’s to recover from infamous dieselgate scandal. The automaker's Fix for 'Dieselgate' Affected EA189 Engines has been approved by the German Federal Motor Transport Authority, following which it released a list of its 9 European Dieselgate affected vehicles of 2016 Model Year.
